About New Labour & Industrial Laws
India has implemented four new, comprehensive Labour Codes, effective as of November 21, 2025. These codes consolidate 29 existing central labour laws to simplify regulations, expand social security, and enhance worker protections and business flexibility across various sectors.
The four new Labour Codes are:
- The Code on Wages, 2019
- The Industrial Relations Code, 2020
- The Code on Social Security, 2020
- The Occupational Safety, Health and Working Conditions Code, 2020
Key Changes and Benefits
The new framework introduces significant changes for both employers and employees:
- Universal Minimum Wages and Timely Payment: All workers now have a statutory right to a minimum wage, and employers must ensure timely payment of wages within a specified timeframe (e.g., within 7 days for monthly wages). A “national floor wage” will be set by the Central Government as a baseline for states.
- Expanded Social Security: The Code on Social Security extends benefits like Provident Fund (PF), Employees’ State Insurance (ESI), and gratuity to a wider range of workers, including gig, platform, and unorganised sector workers, which were previously excluded.
- Mandatory Appointment Letters: Employers must provide formal appointment letters to all employees, providing clarity on employment terms, wages, and social security entitlements, thereby increasing formalization of the workforce.
- Revised Wage Definition: The definition of “wages” mandates that the basic pay component must constitute at least 50% of the total remuneration, which may lead to higher social security contributions (PF and gratuity) but potentially lower take-home pay for some employees.
- Fixed-Term Employment (FTE): FTE workers are to receive the same benefits as permanent workers and are eligible for gratuity after just one year of service, instead of five.
- Enhanced Safety and Working Conditions: The OSH Code introduces mandatory annual health check-ups for workers over 40 and allows women to work night shifts in all establishments with proper consent and safety measures.
- Simplified Compliance: For employers, the reforms introduce a single registration, single license, and single return filing system across all four codes, replacing multiple fragmented processes. The “Inspector-cum-Facilitator” system is designed to guide compliance rather than penalize first-time offenses.
- Dispute Resolution: The Industrial Relations Code streamlines the resolution process through two-member industrial tribunals and provides a worker re-skilling fund for retrenched employees.
