Lexis Nexis’s Crime, Punishment and Due Sentence: Judicial Approach to Guilt in Criminal Justice by Humayun Rasheed Khan – 1st Edition 2024.
The criminal justice system lies at the absolute heart of any functioning society. Yet, despite clear penal codes, India has historically suffered from an absence of clear sentencing guidelines. Crime, Punishment and Due Sentence (1st Edition, 2024), published by LexisNexis, bridges this critical gap. Authored by distinguished jurist Dr. Humayun Rasheed Khan, this treatise captures recent advancements in criminology and psychology, explicitly recognizing that not all offenders are similar and that flexibility is mandatory in the administration of justice.
Navigating the Sentencing Phase
For defense teams mitigating client exposure and judicial officers tasked with pronouncing judgment, the sentencing phase is fraught with intense debate. This book breaks down the fine nuances of that process:
Individualization vs. Mandatory Minimums: A deep, actionable examination of the potential tension between the court’s equitable power to treat offenders individually and the rigid mandatory sentences prescribed by the legislature.
Mercy & Leniency: Analyzes the exact statutory “place of leniency” and the “role of mercy” in modern sentencing without compromising the rights of victims or the protection of witnesses.
Global Sentencing Systems: Compares the Indian framework against systematic sentencing approaches utilized in Europe, North America, Australia, New Zealand, and Islamic jurisdictions.
Contextualized for the New Criminal Laws
Crucially, this text does not rely on outdated colonial precedents. It provides direct, highly relevant references to the new criminal justice frameworks defining Indian courts today:
The Bharatiya Nyaya Sanhita (BNS), 2023
The Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023
The Bharatiya Sakshya Adhiniyam (BSA), 2023
Who Should Buy This Book?
Judges & Magistrates: A trusted, structured bench referencer for issuing balanced, legally sound sentencing orders that survive appellate scrutiny.
Criminal Defense Lawyers & Prosecutors: The ultimate courtroom weapon for arguing mitigating factors, victim compensation, and the boundaries of mandatory minimums.
Legal Academicians & Researchers: A foundational text for universities and judicial training academies exploring the intersection of criminology, psychology, and penal reform.
